Ninth Circuit Court Rejects Trump Administration's Birthright Citizenship Appeal

The Ninth Circuit Court denied the Trump administration's emergency appeal against an injunction on birthright citizenship, citing lack of strong legal grounds for success.
The Ninth Circuit Court of Appeals on Wednesday rejected the Trump administration's request for emergency relief from an injunction blocking its birthright citizenship executive order, marking another legal defeat for the administration.
The judges ruled unanimously, stating that the administration failed to demonstrate that it was "likely to succeed on the merits" of the appeal. As a result, they ruled 3-0 against the emergency request.
"The emergency motion for a partial stay of the district court's February 6, 2025 preliminary injunction is denied," the court announced.
This decision was issued on the same day that Trump's birthright citizenship executive order was scheduled to take effect.
Multiple district courts across the country have previously blocked this order, which led the Trump administration to seek emergency relief earlier this month.
